1. Introduction

Welcome to Fuzzish ("Platform," "we," "us" "our").

These Terms of Service ("Terms") govern your access to and use of Fuzzish mobile application, website, and related services(collectively, the "Platform").

By creating an account or using Fuzzish, you agree to be legally bound by these Terms.
If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 13 years old to use Fuzzish.
If you are under 18, you confirm that you have permission from a parent or legal guardian.
You confirm that you have the legal capacity to enter into this agreement.

We do not knowingly collect personal data from children under 13. Accounts found to violate this requirement will be terminated.

3. User Accounts

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activity occurring under your account.
You may not sell, transfer, or share your account.

We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

4. User Content & Intellectual Property

4.1 Ownership
You retain ownership of any content you upload to Fuzzish, including music, images, and videos (“User Content”).

4.2 License to Fuzzish

By uploading User Content, you grant Fuzzish a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to:

host, store, cache, reproduce, transcode, distribute, stream, publicly display, and perform your content;
create technical copies, previews, waveforms, snippets, thumbnails, and metadata;
promote and feature content within the Platform, app listings, and marketing materials related to Fuzzish.

This license exists solely for operating, improving, and promoting the Platform and ends when your content is removed, except where retention is required by law or for technical backups.

4.3 Content Responsibility

You represent and warrant that:

you own or have the necessary rights to upload the content;
your content does not infringe copyright, trademark, privacy, or other rights;
your content complies with applicable laws.

You are solely responsible for your User Content.

5. Content Upload Requirements and Technical Limits

To ensure platform performance and quality, Fuzzish enforces upload requirements.

5.1 Music Uploads

Accepted formats: WAV (16-bit or 24-bit, 44.1kHz or 48kHz) and FLAC.
Maximum file size per track: 250 MB.
Maximum track length: 15 minutes.
Audio may be transcoded (e.g. AAC), normalized, or processed for streaming.

5.2 Image Uploads

Accepted formats: WebP or JPEG.
Maximum file size: 2 MB for standard images, 4 MB for profile and cover images.
Images may be resized, compressed, or reformatted.

5.3 Video Uploads

Accepted format: MP4 (H.264 video and AAC audio).
Maximum duration: 30 seconds.
Maximum resolution: 1080×1920.
Maximum file size: 50 MB.
Videos may be compressed or transcoded.

5.4 General Rights to Modify Content

Fuzzish reserves the right to:

reject, remove, or modify content that exceeds limits or is technically unsuitable;
remove corrupted or non-compliant files.

6. Prohibited Conduct

You may not use Fuzzish to:

upload copyrighted content without authorization;
upload content that is illegal, abusive, hateful, or sexually explicit;
harass, threaten, or impersonate others;
distribute malware, spam, or attempt to exploit the Platform;
scrape, reverse engineer, or interfere with Platform systems.

Violations may result in content removal, suspension, or permanent termination.

7. Copyright & DMCA Policy

We respect intellectual property rights.

If you believe content infringes your copyright, submit a notice to contact@fuzzish.com including:

identification of the copyrighted work;
identification of the infringing material;
your contact information;
a good-faith statement and signature.

Repeat infringers may have their accounts permanently terminated.

8. Moderation & Enforcement

Fuzzish is not obligated to host any content.
We may remove or restrict content or accounts at our sole discretion.
We are not liable for moderation decisions or content removal.

9. Account Termination

9.1 By You

You may delete your account at any time via account settings or by contacting contact@fuzzish.com.

9.2 By Us

We may suspend or terminate accounts for violations of these Terms or applicable law.

Upon termination:

access to the account is revoked;
content may be removed or retained as required by law or backups;
usernames may be recycled.

10. Data & Privacy

We collect and process personal data in accordance with our Privacy Policy, which forms part of these Terms.

11. No Warranty

Fuzzish is provided “as is” and “as available”.

We make no warranties regarding:

availability, uptime, or error-free operation;
accuracy or reliability of content;
fitness for any particular purpose.

12. Limitation of Liability

To the maximum extent permitted by law:

Fuzzish is not liable for indirect, incidental, or consequential damages.
Our total liability shall not exceed €100 or the amount you paid to us in the last 12 months, whichever is greater.
We are not responsible for User Content.

13. Indemnification

You agree to indemnify and hold harmless Fuzzish LTD from any claims, damages, or expenses arising from:

your use of the Platform;
your User Content;
your violation of these Terms or applicable law.

14. Payments & Future Features

Fuzzish may introduce paid features or subscriptions in the future.
Any such features will be subject to additional terms and applicable app store rules.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of Ireland.
Disputes shall be subject to the exclusive jurisdiction of Irish courts, unless otherwise required by law.

16. International Users

Users outside the EU may have additional rights under local laws.
Nothing in these Terms limits mandatory consumer rights.

17. Assignment

Fuzzish may assign or transfer these Terms in connection with a merger, sale, or restructuring.

18. Severability

If any provision is found invalid, the remaining provisions remain in full force.

19. Changes to These Terms

We may update these Terms from time to time.
Material changes will be communicated via email or in-app notification.

Continued use after changes constitutes acceptance.
